Do I have to make a Last Will?
If you die without a legal Last Will and Testament (a foreign or Thai will) your estate will be distributed according to the system of the law to your statutory heirs. If you have not made a valid last will or testament your wishes may not necessarily be carried out when you die. Your spouse may not be entitled to your entire estate, or if you are unmarried but living with a partner, your partner may not be entitled to anything at all, or if you are in a second marriage and you have children from a first marriage, your children may not be entitled to anything as your entire estate in Thailand could pass to your new spouse.
I have a foreign will, do I still need to make a Thai will?
This depends on your personal situation, but generally you do not need to make a separate will for Thailand. If you live in Thailand and if you are married to a Thai national, or if you have specific ideas on how you require your Thailand estate to be distributed when you die, then it is recommended to make a Thai will. It is possible to make a will specifically for assets in Thailand (a will for your Thailand estate). If you do not have family relations in Thailand and you do not want to dispose of your assets in Thailand differently from your existing will in your home country then there is no need to make a separate last will and testament for Thailand.
