The prenuptial or ante nuptial agreement in Thailand is a written deed of arrangement between two people who are planning to marry setting out the terms of possession of assets, control of the community property and potential division of community assets should the marriage later be dissolved. The prenuptial or ante nuptial agreement must be registered at the District Office (signed by both parties, including 2 witnesses) where the marriage takes place prior to the marriage of the parties.

When the couple has assets in other countries with their own rules regarding the couple's martimonial community property regime, that country may recognize a 'choice of law' clause in the prenuptial agreement (i.e. when normally the laws regarding community property of that country would apply (e.g division of property in a divorce), the Court will recognize a choice of law clause in the prenuptial agreement). |
