Prenuptial sample template agreement for Thailand

The purpose of a prenuptial agreement in Thailand is to record the parties' personal assets, arrange management over common properties during the marriage and intentions as to the division of assets in the event that the marriage breaks down. The following sample prenuptial agreement shows the heading of the contract and part of the Englsih text content. The full prenuptial template contains optional clauses and is a complete approx 11 pages contract with a verified Thai translation.

Mr. _____________, __ years of age, a ____ national and holding, passport number, ____ residing at _________, hereinafter referred to as the “Prospective Husband” of the one part, a copy of the passport is attached hereto as Exhibit A.

RECITALS / โดยที่

Prospective Husband and Prospective Wife contemplate marriage in the near future under the law of Kingdom of Thailand and wish to establish their respective rights and responsibilities regarding each other’s management of the properties during the marriage.

Prospective Husband and Prospective Wife have made a full and complete disclosure to each other of all of their financial assets and liabilities, as more fully set forth in the accompanying Financial Statements, attached hereto as Exhibits C and D.

Prospective Husband and Prospective Wife hereby mutually agree that the management of the personal property and the common property shall be governed by this Prenuptial Agreement.

NOW AND THEREFORE THE PARTIES HEREBY AGREE AS FOLLOWS:

ดังนั้นคู่สัญญาจึงได้ตกลงกัน โดยมีข้อความ ดังต่อไปนี้

1. PERSONAL PROPERTY (SIN SUAN TUA) /สินส่วนตัว

Personal Property of the Prospective Husband consists of:

1. Property belonging to Prospective Husband before marriage;
2. Property for personal use, dress or ornament suitable for station in life, or tools necessary for carrying on the profession of the Prospective Husband;
3. Property acquired by Prospective Husband during marriage through a will or gift;
4. As regards item (1) - item (3) mentioned above, if it has been exchanged to other property, other property has been bought or money has been acquired from selling it, such other property or money acquired shall be personal property of Prospective Husband;
5. Where item (1) - item (4) mentioned above has been totally or partly destroyed but replaced by other property or money, such other property or money shall be personal property of Prospective Husband; and
6. Property as listed in Exhibits C.

สินส่วนตัวของฝ่ายชายได้แก่

1. ทรัพย์สินที่ฝ่ายชายมีอยู่ก่อนสมรส
2. ทรัพย์สินที่เป็นเครื่องใช้สอยส่วน ตัว เครื่องแต่งกาย หรือเครื่องประดับกายตามควรแก่ฐานะหรือเครื่องมือเครื่องใช้ที่จำเป็นในการ ประกอบอาชีพหรือวิชาชีพของฝ่ายชาย
3. ทรัพย์สินที่ฝ่ายชายได้มาระหว่างสมรสโดยการรับมรดก หรือโดยการให้โดยเสน่หา
4. หากทรัพย์สินในข้อ (1) – ข้อ (3) ดังกล่าวข้างต้นได้แลกเปลี่ยนเป็นทรัพย์สินอื่นก็ดี ซื้อทรัพย์สินอื่นมาก็ดี หรือขายได้เป็นเงินมาก็ดี ทรัพย์สินอื่นหรือเงินที่ได้มานั้นเป็นสินส่วนตัวของฝ่ายชาย
5. หากทรัพย์สินในข้อ (1) – ข้อ (4) ได้ถูกทำลายไปทั้งหมดหรือแต่บางส่วนแต่ได้ทรัพย์สินอื่นหรือเงินมาทดแทน ทรัพย์สินอื่นหรือเงินที่ได้มานั้นเป็นสินส่วนตัวของฝ่ายชาย และ

6. VALIDITY OF THE AGREEMENT / ความสมบูรณ์แห่งสัญญาก่อนสมรส

Prospective Husband and Prospective Wife shall register this Agreement in the Marriage Register at the time of marriage registration stating that this Agreement is thereto annexed.

ฝ่ายชายและฝ่ายหญิงจะต้องจดแจ้งสัญญาฉบับนี้ไว้ในทะเบียนสมรสพร้อมกับการจดทะเบียนสมรสว่าได้มีสัญญาฉบับนี้แนบไว้

7. ALTERATION AND TERMINATION /การเปลี่ยนแปลง เพิกถอนสัญญาก่อนสมรส

Prospective Husband and Prospective Wife fully acknowledge that after marriage this Agreement can not be altered or terminated except by authorization of the Court.

ฝ่ายชายและฝ่ายหญิงทราบเป็นอย่างดีว่า เมื่อสมรสแล้วจะเปลี่ยนแปลงเพิกถอนสัญญาฉบับนี้ไม่ได้ นอกจากจะได้รับอนุญาตจากศาล

8. DIVISION OF COMMON PROPERTY UPON DIVORCE /การแบ่งสินสมรสเนื่องจากการหย่า

9. SEVERABILITY / โมฆะแยกส่วน

In the event it is determined that any provision of this agreement is invalid because it is contrary to applicable law, that provision is deemed separable from the rest of the agreement, such that the remainder of the agreement remains valid and enforceable.

ในกรณีที่ข้อสัญญาใดในสัญญาฉบับนี้ไม่สมบูรณ์หรือตก เป็นโมฆะเนื่องจากขัดแย้งกับบทบัญญัติแห่งกฎหมายซึ่งใช้บังคับอยู่ ให้ถือว่าข้อสัญญานั้นแยกส่วนจากข้อสัญญาส่วนที่เหลืออยู่ซึ่งมีผลสมบูรณ์ และใช้บังคับได้ตามกฎหมาย

10. LANGUAGE / ภาษา

This agreement is made in the English language and Thai language. In case of any legal dispute over any interpretation of any clause in this agreement, the English language shall be used for interpretation.

สัญญาฉบับนี้ได้ทำขึ้นเป็นภาษาอังกฤษและ เป็นภาษาไทย ในกรณีที่มีข้อขัดแย้งของถ้อยคำหรือความหมายตามสัญญาฉบับนี้ คู่สัญญาตกลงให้ถือตามสัญญาฉบับภาษาอังกฤษ
