The right of usufruct in Thailand is governed by the Thailand Civil and Commercial Code sections 1417 to 1428 and described in section 1417 as 'an immovable property may be subjected to a usufruct by virtue of which the usufructuary is entitled to the possession, use and enjoyment of the property. He has the right of management of the property'.
The right of usufruct can be created for a period of time or for the life of a person or persons. In any case the usufruct comes to an end at the death of the person or last person granted the right of usufruct. The right of usufruct cannot survive the life of a person or persons given the usufruct. Note: the right of usufruct must be registered on the land title deed copy of the owner and the original copy as held by the local land office. It is for example not possible to register a right of usufruct over land that not yet has a full title deed, or a real estate property that is encumbered with a mortgage.
