Decision 1413-2547 (2004): Lump-Sum Education Fund Approved
The Thai mother proved that private-school tuition and future university fees would exceed ordinary monthly maintenance. Applying section 1564 Thai civil code , the Supreme Court required the foreign father to (1) pay ฿15 000 per month and (2) deposit a lump-sum of ฿500 000 into a court-controlled account earmarked for the child’s education and major medical expenses.
Practical impact
- Court may capitalise foreseeable “extraordinary” costs into a lump-sum fund.
- Such funds are held in trust; withdrawals need court approval to protect the child.
- Useful precedent when private schooling or chronic health care is anticipated.
