Decision 3290/2545 (2002): Paternity & Support Ordered Together
The Thai mother sued a foreign resident for legitimation and child maintenance in a single action. DNA evidence proved paternity. The Supreme Court ordered the father to (1) register paternity and (2) pay ฿10 000 per month until the child reached majority, holding that nationality or absence from Thailand does not excuse the duty under section 1564 civl code.
Practical impact
- Paternity and financial relief can be bundled—no need for two lawsuits.
- Foreign domicile is irrelevant once paternity is proved.
- Enforcement can proceed via international treaty mechanisms if the father remains abroad.
