Term Definition
3290-2545
A Thai mother can sue a foreign father for both paternity and child support in one case. The Court ruled that proven paternity creates a support duty under section 1564 civil and commercial code.

Decision 3290/2545 (2002): Paternity & Support Ordered Together

The Thai mother sued a foreign resident for legitimation and child maintenance in a single action. DNA evidence proved paternity. The Supreme Court ordered the father to (1) register paternity and (2) pay ฿10 000 per month until the child reached majority, holding that nationality or absence from Thailand does not excuse the duty under section 1564 civl code.

Practical impact

  • Paternity and financial relief can be bundled—no need for two lawsuits.
  • Foreign domicile is irrelevant once paternity is proved.
  • Enforcement can proceed via international treaty mechanisms if the father remains abroad.
