Mediation
Court-run civil mediation under the Civil Procedure Code (sections 20 bis & 20 ter). Pre-filing has no court fee; if settled, the judge can issue a consent judgment; if not, the limitation period may be extended 60 days.

Court Mediation in Thailand — Facts

Legal basis

  • Civil Procedure Code (CPC) section 20 bis, mediation during a pending case (judge may mediate or appoint a conciliator).
  • CPC section 20 ter, pre-filing mediation (apply at the court with jurisdiction; both sides must consent).

Court-run program (not private). Parties may attend with or without lawyers; in person or online.

Costs

  • section 20 ter (pre-filing): No court fee for the application & proceedings.
  • section 20 bis (during case): no extra mediation fee; normal case filing fees still apply.

Who appoints the mediator?

  • The court (judge may mediate or appoint a conciliator/mediator from the court’s panel).
  • Parties may participate with or without lawyers (interpreters commonly allowed).

Outcome

  • If settled: the judge can issue a consent judgment (often same-day under §20 ter).
  • If not settled: normal procedure continues; under section 20 ter the limitation period extends 60 days from mediation end.
