About This Prenuptial Agreement Preview
This bilingual prenup template is designed for use in connection with marriage and prenuptial registration in Thailand. It allows the parties to record their assets and liabilities before marriage, identify Personal Property, and set out permitted arrangements for the management of Common Property during the marriage. The agreement is intended to operate within the Thai matrimonial-property rules and does not override provisions of Thai law that cannot be changed by private agreement. For a detailed explanation of validity, registration and the legal limits of Thai prenups, see our Prenuptial Agreement in Thailand legal guide.
This preview reproduces the introductory provisions and the first three Clauses in bilingual Thai and English. The remaining Clauses are summarized so that you can review the scope, structure and drafting style before purchasing the complete editable documents.
A Thai prenup can nevertheless make meaningful and binding property arrangements where permitted by law. The practical point is that foreign-style prenup clauses cannot simply be imported or translated and assumed to be enforceable in Thailand; they must be drafted within the limits of the Thai Civil and Commercial Code.
Sample document only. This preview is intentionally incomplete and is provided for evaluation purposes. It should not be signed or submitted for marriage registration.

The complete package is designed for couples preparing to register their marriage and prenuptial agreement in Thailand. It includes the editable agreement documents and supporting schedules needed to prepare the final agreement for registration.
- Thai-English bilingual Prenuptial Agreement – editable Word document.
- Thai-only Prenuptial Agreement for registration where preferred by the Amphur or Khet.
- Separate signature page.
- Exhibit A – identification document for the prospective husband.
- Exhibit B – Thai identification and house-registration documents for the prospective wife.
- Exhibits C and D – financial statements / lists of each party’s assets and liabilities.

The documents are intended for self-completion using the accompanying instructions. If you would prefer assistance, an optional completion and document review service is also available.
How to Complete and Register the Prenuptial Agreement in Thailand
1. Complete the Agreement Before Marriage
Fill in the parties’ names, addresses, dates and other required information and complete the relevant exhibits. Remove unused options and drafting instructions from the final document before it is signed.
The Thai and English contractual text should correspond. Where both a Thai-only and bilingual version are prepared, the Thai contractual provisions should remain consistent between the two documents.
2. Prepare the Asset and Liability Exhibits
Exhibits C and D are used to record the general nature of each party’s assets and liabilities before marriage. The schedules may be general or detailed, but the parties should retain supporting evidence showing ownership and the source of funds where this may later become relevant.
3. Confirm the Registration Format with the Amphur or Khet
A prenuptial agreement in Thailand must be dealt with at the time the marriage is registered. Before the appointment, contact the relevant Amphur or Khet to confirm whether the registrar will accept the bilingual agreement or prefers a Thai-only agreement for registration.
A longer agreement may be attached to the marriage registration, with the register recording that the separate prenuptial agreement is attached.
4. Parties and Witnesses
Where the prenuptial agreement is made as a separate written agreement for attachment to the Marriage Register, the parties should attend with at least two witnesses and sign the required documents in connection with the marriage and prenuptial registration.
5. Registration Cannot Be Added Later
The agreement is intended to be presented and registered together with the marriage registration. A prenuptial agreement that is not properly made and recorded at the time of marriage cannot simply be added after the marriage has already been registered.
6. Keep Evidence of Personal and Marital Property
Asset schedules are useful evidence, but good recordkeeping should continue after marriage. Bank statements, transfer records, purchase agreements and other documents can help establish whether money or property originated from Personal Property or Common Property.
7. Thai Land and the Foreign Spouse
The matrimonial-property classification of property between spouses is separate from registered ownership under Thai land law. A prenuptial agreement does not create a right for a foreign spouse to be registered as the owner of Thai land where such ownership is prohibited by law.
8. Foreign Assets and a Separate Foreign Prenup
The Thai agreement is drafted under Thai law. Couples with substantial property, income or future residence outside Thailand should consider whether a separate agreement under the law of the relevant foreign jurisdiction is appropriate for those foreign assets.
The complete package contains more detailed preparation and registration instructions, including document checklists, Amphur filing guidance, asset schedules, optional provisions and legal limitations.
