The right of superficies separates ownership over the land and ownership over the building. The right of superficies is used if the owner of the construction is not the same as the owner of the land. The superficiarius, who has built upon the land of another and granted the right of superficies, obtains a registered ownership over the structures without obtaining ownership over the land. The right of superficies may be constituted for the benefit of an existing building or a building under construction, however, local Land Offices in Thailand only allow registration in case of undeveloped land or a building under construction.
