A usufruct is a legal right granted to a person to use and benefit from property that belongs to someone else, without owning it. The person who holds the usufruct is called the usufructuary, while the person who retains ownership is referred to as the naked owner. Under Thai law, a usufruct is classified as a limited real right and may be registered over immovable property, such as land or buildings, pursuant to Section 1417 of the Thai Civil and Commercial Code. It is considered “limited” because ownership remains with the landowner. The usufructuary may use the property and derive income or other benefits from it, but cannot sell or dispose of the property itself.
Usufruct rights are often used in Thailand in personal or family arrangements, for example, allowing a foreign spouse to reside on and use land that is legally owned by their Thai partner, while respecting the restrictions on land ownership for foreigners.
