Hotel Act B.E. 2547 (2004) – English Translation

This English translation of Thailand’s Hotel Act B.E. 2547 (2004) covers the principal legal framework for hotel businesses and temporary paid accommodation, including licensing, hotel management, guest records, official supervision and penalties. The Act must be read together with the Ministerial Regulations and official notifications issued under it. These subordinate rules determine matters such as hotel categories, operating standards, building requirements and the exclusion for certain notified small accommodation establishments.

The Ministerial Regulation Prescribing Categories and Criteria for the Operation of Hotel Businesses (No. 2), B.E. 2566 (2023) amended Thailand’s 2008 Hotel Ministerial Regulation. Among other changes, it expanded the regulated exception for certain small accommodation establishments from four rooms and 20 guests to eight rooms and 30 guests.

The Land and Buildings Tax Act B.E. 2562 (2019) introduced a new nationwide system for the taxation of land and buildings in Thailand. The Act replaced the former Household and Land Tax Act B.E. 2475 (1932) and the Local Maintenance Tax Act B.E. 2508 (1965), modernising Thailand's local property tax system and creating a single legal framework for the assessment and collection of land and building tax by local government organisations.

The Building Control Act B.E. 2522 (1979) establishes Thailand's legal framework for the construction, alteration, use and demolition of buildings. Rather than prescribing every technical requirement itself, the Act empowers the Minister and local authorities to issue ministerial regulations and local building regulations governing matters such as building design, structural safety, fire protection, sanitation, setbacks, height restrictions and permitted land use.
