Being divorced in Thailand means that the marriage has been legally terminated either by:
- registration of a mutual-consent divorce at the Amphur (district office), or
- a final court judgment, including a mediated consent judgment, later recorded in the Thai civil registry.
When the divorce becomes final
Mutual-consent Amphur divorce: final upon registration. The registrar issues the Kor Ror 7divorce certificate and the civil-status record is updated immediately.
Court divorce: final when the judgment is final, after the appeal period or by consent judgment. The judgment must then be registered at the district office to update the civil register and obtain Kor Ror 7.
What changes once the divorce is final?
Remarriage: legally possible once the divorce is final and registered.
Names and IDs: surname, Thai ID, passport, banking and insurance records may need updating.
Property and debts: follow the registered divorce agreement or court judgment.
Children: custody, parental power and child support follow the agreement or court order.
Use abroad: certified translation and legalization may be required for foreign authorities.
Tip: If the divorce is settled in court mediation, ask for a consent judgment. Once final and registered, it has the effect of a court divorce and is directly enforceable as a court order.
